Attentato alla Costituzione! Sui cronici ritardi nella compilazione dell’elenco dei quarantacinque ed i loro effetti

According to art. 135 Cost., in impeachment procedure against the President of Republic, apart from the ordinary judges of the Constitutional Court, there shall also be sixteen members chosen by lot from among a list of fourty-five citizens having the qualification necessary for election to the Senate.. This list is prepared by the Parliament in joint session of the members of both Houses every nine years through election using the same procedures as those followed in appointing ordinary judges. The nine-years deadline has not been respected by the Parliament several times. This article reflects about the effects of this nonelection: does the list of fourty-five citizens mantain constitutional validity beyond the date of expiry?
