Abstract: Drawing on a recent decision by the Court of Cassation on the crime of facilitation of irregular migration – in particular, in the context of “ethnic networks” – the article addresses the issue of humanitarian and solidarity support to migrants. Against a widespread opinion in scholarship, it argues that rescue and humanitarian actions shall be deemed legitimate because they do not amount to the constituent elements of the offence of migrant smuggling as the scope of the criminal provision explicitly excludes them.
